- Acceptance of Terms. By activating or using any EQ Telecom service, device, or website feature (including purchasing a plan or device), you accept and agree to these Terms & Conditions (the “Terms”) and our Privacy Policy and Acceptable Use Policy. You represent that you are at least the age of majority in your jurisdiction (or have obtained parental/guardian consent if you are a minor) and have the legal right to enter into this Agreement. Your Agreement with EQ Telecom begins when you perform any of the following: (a) sign up for or activate service; (b) use the service; (c) provide payment for service or devices; or (d) otherwise indicate assent to these Terms. If you do not agree to these Terms, do not activate or use our services.
- Service Description. EQ Telecom is an online-only wireless phone service provider. All services are prepaid and no-contract; you pay in advance for your plan. However, you can sign-up for auto-pay . This is cancelable by the customer. Customers may purchase service plans and devices either separately or as bundles. We offer two categories of plans:
- Children’s Plans: Voice (talk) and SMS text messaging only, with optional limited mobile data. Data speeds on child plans are intentionally limited (throttled) to encourage offline time and digital wellness. Devices for child plans are basic phones with limited app functionality.
- Adult Plans: Voice, SMS, and tiered mobile data. Adult data plans have multiple tiers; after a certain usage threshold, speeds are progressively throttled to promote reduced screen time. An adult may also choose a child-style plan if desired.
All service plans are prepaid: you must pay for future service in advance. Device features, plan details, and coverage may change; see our website for current information. Service is currently available only in Utah; we plan to expand nationwide.
- Activation and Account Setup. To use EQ Telecom service, you must activate a device and a SIM. Activation requires a compatible unlocked phone and a SIM card or embedded SIM (eSIM). If your device supports eSIM, you may choose eSIM instead of a physical SIM. During activation, you will provide personal information (name, billing address, etc.) and verify your identity (e.g. government-issued ID) as required by law. Your account is accessible via our website; you agree to keep your account credentials (username, password, PIN) secure and are responsible for any activity on your account.
- Billing and Payment. All charges for service and devices are your responsibility. You must pay the required fees and taxes as they become due. We require prepayment for service; for example, monthly service fees or multi-month plan fees must be paid before service is provided. We accept payment by credit/debit card or other methods as described on our website. If you do not make the next monthly payment and exhaust your prepaid service balance, your service will be suspended until you add more service. No interest is paid on prepayments. Any charges not paid when due may incur fees or result in suspension or termination of service.
- Customer Support. EQ Telecom provides customer support via telephone, online chat, and email. Support hours are Monday through Friday, 8:00 AM to 5:00 PM Mountain Time. We aim to respond to email inquiries within two (2) business days. Because we are an online-only provider with no retail stores, all service orders, activations, and account management must be handled through our website and support channels.
- Acceptable Use Policy. You agree to use EQ Telecom services and devices only for lawful, personal purposes. Prohibited uses include any unlawful, abusive, infringing, deceptive, or otherwise improper activity. Examples of prohibited conduct (this list is not exhaustive) include:
- Interfering with the network or avoiding payment obligations.
- Harassing, defrauding, intimidating, threatening, or invading the privacy of others.
- Unauthorized marketing, auto-dialing, or bulk messaging.
- Impersonation, spam, or use of bots/robots to access service.
- Altering or disguising the origin of calls or messages, including providing false caller ID information.
- Violating any applicable law, regulation, or third-party rights.
- Distributing viruses, malware, or launching denial-of-service attacks.
EQ Telecom reserves the right to monitor service usage for compliance with this Acceptable Use Policy. We may immediately suspend or terminate your service, at our sole and absolute discretion, if we determine that you have used the service or device for any prohibited or unlawful purpose. In such cases:
- You will remain responsible for all charges incurred through the end of your current billing period, including any unbilled charges and, if applicable, a termination fee, all of which will become immediately due and payable.
- Any prepaid balances may be forfeited.
EQ Telecom relies on its upstream provider, for network-level enforcement of robocall mitigation protocols, Industry Traceback Group (ITG) participation, and compliance with traceback investigations and Do Not Originate (DNO) requests.
If EQ Telecom is notified by its upstream provider of potential unlawful use, we will cooperate fully in any investigation, including forwarding relevant customer account information to appropriate authorities for investigation and prosecution. You consent to our forwarding of such information as necessary.
Additionally, EQ Telecom will comply with lawful law enforcement requests, including subpoenas, court orders, and government requests under the Patriot Act, to protect its rights, property, and to prevent imminent harm to customers or others.
- Service Suspension and Termination. EQ Telecom may change, limit, suspend, or terminate your service or this Agreement at any time, with or without notice, for any reason (e.g. non-payment, violation of these Terms or our policies, fraudulent activity, misuse of the service, or any other reason we deem appropriate). For example, if you fail to make the required payments on time, we may suspend your service. If a suspension is not cured within a specified period (typically 60 days), the service will be cancelled and any remaining balance forfeited. Service suspension or termination does not relieve you of the obligation to pay charges incurred before suspension. If your service is reinstated after suspension, reconnection fees may apply. In some cases (such as prolonged nonuse or inactivity) your phone number may be reclaimed and reassigned.
- Emergency Services (911). Your device supports dialing 9-1-1 for emergency assistance. However, EQ Telecom does not guarantee uninterrupted connectivity or location accuracy for emergency calls. 9-1-1 calls require device connectivity to our network (or functioning internet for Wi-Fi calling if offered). If your device is outside our coverage, powered off, or uses Wi-Fi calling without proper location registration, your 9-1-1 call may be delayed, dropped, or routed incorrectly. You acknowledge that emergency response capabilities via our service have limitations beyond our control. Always provide responders with your exact location if possible.
- Privacy and Data. Our Privacy Policy (available on the website) governs how we collect, use, and protect your personal information. By using our services, you agree to our collection and use of personal data as described in that policy. We may collect data such as your name, billing information, device identifiers, and usage patterns. We may share personal information with law enforcement or third parties if required by law, regulation, or a court order. We encourage you to read the Privacy Policy carefully. We may update our Privacy Policy from time to time and will post changes on our website.
- Intellectual Property. The EQ Telecom name, logo, and all content and materials provided through our service or website (including software, text, graphics, and design elements) are owned by EQ Telecom or our licensors and are protected by intellectual property laws. You are granted a limited license to use the service and its content for your personal, non-commercial use only. Except as expressly authorized, you may not copy, modify, distribute, sell, or create derivative works based on our intellectual property. Any unauthorized use of our trademarks, software, or content is strictly prohibited. Violation of these rights may subject you to legal action.
- Website and Account Security. Your use of EQ Telecom’s website, portals, and account management tools is subject to any applicable Website Terms of Use posted online. If you create an online account, you agree to provide accurate information and to keep your account login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.
- Changes to Terms. We may update these Terms at any time (for example, to reflect changes in the law or our services). When we do, we will post the revised Terms on our website. Changes become effective when published. Your continued use of any service or acceptance of any charges after that date will constitute your acceptance of the updated Terms. We will try to provide advance notice of significant changes (e.g. via email or website announcement), but your responsibility is to review the Terms periodically.
- Dispute Resolution. Any dispute related to these Terms, or your service will be resolved as follows: First, you must contact us and attempt in good faith to resolve the issue informally. If not resolved within 60 days, any claim or dispute arising out of or relating to this Agreement, our services, or your devices will be resolved by binding arbitration on an individual basis. Arbitration will be governed by the Federal Arbitration Act, and hearing location will be in a mutually agreed location in Utah. The arbitrator’s decision shall be final and binding, subject to very limited rights of appeal under applicable law. You and EQ Telecom both waive any right to a jury trial or to participate in a class-action lawsuit regarding these Terms. Notwithstanding the foregoing, either party may seek judicial relief for disputes regarding intellectual property infringement or unauthorized use of a name, trademark or logo. As an alternative to arbitration, either party may bring qualifying claims in small claims court in the relevant Utah county (up to the jurisdictional limit).
- No Warranty; Limitation of Liability. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY. EQ Telecom and its suppliers expressly disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure service. Equipment you purchase may come with a manufacturer’s warranty; we disclaim all warranties for device hardware. LIMITATION OF LIABILITY: To the fullest extent allowed by law, EQ Telecom and its affiliates and content providers will not be liable for any indirect, incidental, special, punitive or consequential damages (including loss of data, loss of use, or loss of business) arising out of or related to these Terms or the service. Our total liability for any claim will not exceed the amounts you paid for the service or device that gave rise to the claim. In no event will we be liable for failure to provide service or for delays or errors resulting from events beyond our control (such as network outages, extreme weather, or force majeure).
- Governing Law. These Terms and your use of EQ Telecom’s services are governed by the laws of the State of Utah, without regard to its conflict of laws rules. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the federal or state courts located in Utah, and you and EQ Telecom consent to the personal jurisdiction of those courts.
- Miscellaneous. These Terms apply to all services provided by EQ Telecom. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect. No failure or delay by EQ Telecom in exercising any right will constitute a waiver of that right. EQ Telecom may assign its rights under this Agreement to an affiliate or successor. This Agreement, together with any other referenced policies (Privacy Policy, Acceptable Use Policy, etc.), constitutes the entire agreement between you and EQ Telecom regarding the services and supersedes all prior understandings.
- Updates and Notification. EQ Telecom may update these Terms at any time. We will inform users of significant changes via our website or direct communication (e.g. email). It is your responsibility to review the Terms regularly. Continued use of EQ Telecom’s services after updates means you accept the changes.
