1. Acceptance of Terms. By activating, purchasing, accessing, or using any EQ Telecom service, device, SIM, eSIM, website feature, account portal, self-care feature, or related offering, you accept and agree to these Terms & Conditions (the “Terms”), as well as our Privacy Policy, Acceptable Use Policy, Return Policy, and any other policies or disclosures we reference or post on our website from time to time. You represent and warrant that you are at least the age of majority in your jurisdiction, or that you have obtained legally sufficient parental or guardian consent if you are a minor, and that you have the legal capacity and authority to enter into this Agreement. Your agreement with EQ Telecom begins when you do any of the following: (a) sign up for or activate service; (b) use the service; (c) purchase or attempt to purchase service, a device, or related products; (d) provide payment for service or devices; or (e) otherwise indicate assent to these Terms. If you do not agree to these Terms, do not activate, access, or use our services.
2. Service Description. EQ Telecom is an online-only wireless phone service provider. All services are prepaid and no-contract, meaning you pay in advance for your plan. Customers may sign up for AutoPay, which remains cancelable by the customer subject to these Terms and any applicable billing-cycle requirements. Customers may purchase service plans and devices either separately or as bundles.
We offer two categories of plans:
Children’s Plans: Voice (talk) and SMS text messaging only, with optional limited mobile data. Data speeds on child plans are intentionally limited (throttled) to encourage offline time and digital wellness. Devices for child plans are basic phones with limited app functionality.
Adult Plans: Voice, SMS, and tiered mobile data. Adult data plans have multiple tiers, and after certain usage thresholds, speeds may be progressively throttled to promote reduced screen time. An adult may also choose a child-style plan if desired.
All service plans are prepaid. You must pay for future service in advance. Device features, plan details, taxes, fees, surcharges, included features, data allotments, availability, and coverage may change from time to time; please refer to our website for current plan details. Service is currently available only in Utah, and any future expansion is subject to availability, operational readiness, regulatory compliance, carrier support, and geographic eligibility.
EQ Telecom provides service using one or more third-party nationwide wireless networks and related third-party service providers. Coverage is based on the underlying carrier’s native network footprint; however, service performance, including voice quality, data speeds, latency, prioritization, availability of specific features, and availability of roaming or other functionality, may differ from the underlying carrier’s retail offerings. Coverage, service quality, and feature availability are not guaranteed and may vary based on location, signal strength, local conditions, device compatibility, network congestion, maintenance, outages, changes in third-party systems, and other factors beyond EQ Telecom’s control.
EQ Telecom reserves the right, at any time and without liability, to modify, improve, suspend, limit, replace, reconfigure, or discontinue any plan, service, feature, device offering, platform, coverage area, or service component, including due to changes made by our upstream carrier, network partners, software vendors, logistics providers, payment processors, or other third parties.
3. Geographic Eligibility and Availability. Service availability is subject to geographic eligibility, address validation, supported activation regions, and underlying network/provider limitations. EQ Telecom reserves the right to limit, deny, suspend, or terminate service or activations based on location, service address, billing address, shipping address, device eligibility, network availability, fraud-prevention concerns, compliance requirements, or operational constraints. Service may not be available in all areas, and availability in one location does not guarantee availability in another.
4. Devices, SIMs, eSIMs, and Compatibility. To use EQ Telecom service, you must activate a compatible device and a SIM card or embedded SIM (eSIM). Activation requires a compatible unlocked phone or other approved device. Not all devices are compatible with our service, our upstream providers, or all service features. Certain older network technologies, unsupported handsets, unsupported imported devices, devices lacking required certifications, or devices that fail compatibility checks may not work, may only work partially, or may cease working if the network or underlying carrier changes its requirements or sunsets legacy technology.
If your device supports eSIM, you may choose eSIM instead of a physical SIM, if offered. SIMs, eSIMs, activation credentials, device identifiers, and numbers remain subject to network, platform, inventory, and provisioning constraints. EQ Telecom may reject or revoke activation of any incompatible, unsupported, unauthorized, altered, fraudulent, or network-harmful device.
EQ Telecom is not responsible for device performance, device defects, manufacturer defects, unsupported features, battery life, software issues, interoperability issues, operating-system incompatibilities, or any failure of a device to perform as expected on our service. Certain features, including MMS, group messaging, hotspot functionality, Wi-Fi calling, visual voicemail, RCS, iMessage behavior, international functionality, or data services, may depend on the particular device, the underlying network, configuration settings, software version, and third-party systems.
5. Activation and Account Setup. During activation, you may be required to provide personal information such as your name, billing address, shipping address, email address, phone number, device identifiers, date of birth, and government-issued identification or other verification information as required by law, regulation, carrier policy, fraud-prevention procedures, or vendor requirements. You agree that all information you provide will be truthful, accurate, current, and complete.
Your account is accessible through our website and related support or self-care tools. You are responsible for keeping your account credentials, password, PIN, login information, and verification details secure and confidential. You are responsible for all activity occurring on your account, whether or not authorized by you, unless required law provides otherwise. You must promptly notify EQ Telecom if you suspect unauthorized access, account compromise, SIM swap activity, or misuse of your account.
Activation, provisioning, number assignment, device registration, SIM or eSIM download, service changes, feature changes, suspensions, restorations, and other account functions depend in whole or in part on third-party systems. EQ Telecom does not guarantee successful activation, uninterrupted provisioning, immediate number assignment, or immediate service availability.
6. Number Porting and Transfers. If you request to transfer or “port” your number from another carrier, you must provide accurate and complete transfer information, including the account number, transfer PIN, billing ZIP code, account holder information, and any other information requested by us or by the losing carrier. Port requests may be delayed, rejected, canceled, expire, fail, or require resubmission for many reasons, including inaccurate information, mismatched information, carrier-side issues, fraud-prevention measures, line locks, pending balances, unsupported number types, system failures, or third-party processing issues.
EQ Telecom does not guarantee that any number port will complete successfully or within any particular timeframe. You remain responsible for service with your prior carrier until the port is complete and confirmed. Temporary service interruptions, temporary dual service, temporary loss of service, delayed activation, delayed messaging, and other port-related issues may occur. EQ Telecom is not liable for porting delays, failures, rejections, expirations, loss of service during a port, or errors caused by the losing carrier, gaining carrier systems, third-party provisioning systems, or information you provide.
EQ Telecom does not guarantee the availability of any specific telephone number. Telephone numbers are subject to assignment, reassignment, reclamation, availability limits, carrier rules, legal requirements, and operational constraints.
7. Billing and Payment. All charges for services, devices, accessories, SIMs, eSIMs, taxes, surcharges, shipping charges, regulatory charges, administrative charges, recovery charges, and any other amounts associated with your account are your responsibility. You agree to pay all charges, taxes, and fees when due.
EQ Telecom requires prepayment for service. Monthly service fees, multi-month plan fees, device charges, and any applicable upfront charges must be paid before service or shipment is provided, unless we expressly state otherwise. We accept payment by credit card, debit card, and other payment methods as described on our website. By providing a payment method, you authorize EQ Telecom and its third-party payment processors to charge that payment method for all amounts due on your account.
If you enroll in AutoPay, you authorize recurring charges to your designated payment method for service renewals and other authorized charges associated with your account. AutoPay may be canceled by you, but cancellation may not take effect for charges already submitted for processing. Cancellation of AutoPay does not cancel your account, device financing obligation if any, or any other obligations owed to EQ Telecom.
If you do not make the next required payment and your prepaid service balance is exhausted, your service may be suspended, limited, or terminated until you add more service or otherwise cure the deficiency. No interest is paid on prepayments. Any charges not paid when due may incur fees, may cause service interruption, and may result in suspension or termination of service.
All taxes, fees, regulatory charges, cost-recovery charges, and surcharges may change without notice to the extent permitted by law. Where applicable, these amounts may be estimated, passed through, adjusted, corrected, or supplemented after purchase or billing if required by law, tax treatment, network/provider billing, or compliance needs.
Unless otherwise required by law or by an applicable return policy expressly posted on our website, prepaid service charges are nonrefundable after service is purchased or provisioned, and partially used billing cycles will not be prorated.
8. Customer Support. EQ Telecom provides customer support via telephone, online chat, and email. Support hours are Monday through Friday, 8:00 AM to 5:00 PM Mountain Time, excluding holidays or temporary support interruptions. We aim to respond to email inquiries within two (2) business days, but response times are not guaranteed. Because we are an online-only provider with no retail stores, all service orders, activations, account management, and service support must be handled through our website and support channels.
Certain support functions, account actions, billing functions, provisioning actions, and system actions may depend on third-party tools, upstream providers, or platform vendors. EQ Telecom does not guarantee immediate resolution or availability of all support functions at all times.
9. Acceptable Use Policy. You agree to use EQ Telecom services, devices, SIMs, eSIMs, portals, and website tools only for lawful, authorized, and personal purposes, unless we expressly authorize business or other use in writing. Prohibited uses include any unlawful, abusive, infringing, deceptive, harmful, unauthorized, fraudulent, or otherwise improper activity. Examples of prohibited conduct include, without limitation:
EQ Telecom reserves the right to monitor service usage and account activity for compliance with these Terms, our Acceptable Use Policy, fraud-prevention requirements, legal obligations, and network-protection measures. We may immediately suspend, restrict, or terminate your service, at our sole discretion and without prior notice where permitted, if we determine or reasonably suspect that you have used the service or device for any prohibited, unlawful, fraudulent, harmful, or unauthorized purpose.
In such cases:
EQ Telecom relies on its upstream provider for network-level enforcement of robocall mitigation protocols, Industry Traceback Group (ITG) participation, traceback investigations, Do Not Originate (DNO) requests, and related carrier-side enforcement obligations. If EQ Telecom is notified by its upstream provider, vendor, traceback organization, regulator, or law enforcement of potential unlawful or prohibited use, we may cooperate fully in any investigation, including forwarding relevant customer account information, usage information, and related records to appropriate authorities or entities as permitted or required by law. You consent to such forwarding and cooperation to the extent permitted by law.
Additionally, EQ Telecom will comply with lawful law-enforcement requests, subpoenas, court orders, warrants, and other government demands as required or permitted by applicable law in order to protect our rights, property, safety, systems, customers, and the public, and to prevent fraud, unlawful activity, or imminent harm.
10. Service Suspension and Termination. EQ Telecom may change, limit, suspend, restrict, or terminate your service, your account, individual features, your telephone number, your ability to activate, your device access, or this Agreement at any time, with or without notice where permitted by law, for any reason, including non-payment, suspected fraud, suspected unlawful use, violation of these Terms or our policies, misuse of the service, device incompatibility, unsupported device activity, prolonged inactivity, network protection, legal compliance, third-party platform issues, geographic ineligibility, address-validation issues, or any other reason we deem appropriate in our discretion, subject to applicable law.
If you fail to make required payments on time, we may suspend your service. If a suspension is not cured within a specified period, typically 60 days unless we specify a different period, the service may be canceled and any remaining balance may be forfeited to the extent permitted by law. Service suspension or termination does not relieve you of the obligation to pay charges incurred before suspension or termination. If service is reinstated after suspension, reconnection or restoration fees may apply. In some cases, including prolonged nonuse, inactivity, failed renewal, fraud review, or operational reclamation, your phone number may be reclaimed and reassigned.
EQ Telecom is not liable for any damages, losses, missed communications, lost business, lost opportunities, or other consequences resulting from suspension, restriction, cancellation, number reclamation, or termination.
11. Emergency Services (911). Your device may support dialing 9-1-1 for emergency assistance. However, EQ Telecom does not guarantee uninterrupted connectivity, successful routing, accurate location delivery, or uninterrupted availability for emergency calls. 9-1-1 functionality depends on network connectivity, supported device configuration, underlying carrier systems, third-party systems, location services, power availability, SIM/eSIM status, and, where applicable, internet connectivity for Wi-Fi calling.
If your device is outside coverage, powered off, not properly provisioned, has been suspended, is using Wi-Fi calling without proper location registration, is affected by an outage, or is otherwise unable to access the network, your 9-1-1 call may be delayed, dropped, routed incorrectly, or fail. You acknowledge that emergency response capabilities via our service have limitations beyond our control. Always provide responders with your exact location if possible, and do not rely exclusively on any single communication method for emergency access.
12. Privacy and Data. Our Privacy Policy, available on our website, governs how we collect, use, store, disclose, process, protect, and retain your personal information and account-related data. By using our services, you agree to our collection and use of personal data as described in that policy. We may collect information such as your name, contact information, billing information, device identifiers, usage data, IP addresses, location-related information, support records, payment-related information, and account activity.
We may share personal information, account information, or usage information with service providers, network providers, software vendors, payment processors, device vendors, logistics partners, fraud-prevention vendors, analytics providers, law enforcement, regulators, or other third parties to the extent permitted or required by law, contract, operational need, fraud prevention, support delivery, provisioning, billing, compliance, or dispute resolution.
EQ Telecom may also receive, process, and store data through third-party systems that support billing, activation, order processing, self-care, tax calculation, payment processing, shipping, fraud prevention, or regulatory compliance. We encourage you to read the Privacy Policy carefully. We may update that policy from time to time and will post changes on our website.
13. Intellectual Property. The EQ Telecom name, logo, trade dress, website content, text, graphics, software, designs, layouts, documentation, and all related materials provided through our services or website are owned by EQ Telecom or our licensors and are protected by intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to use the service and related content solely for your personal, non-commercial use in accordance with these Terms.
Except as expressly authorized, you may not copy, reproduce, modify, distribute, transmit, publish, display, sell, license, reverse engineer, create derivative works from, or otherwise exploit our intellectual property or content. Any unauthorized use is strictly prohibited and may subject you to civil or criminal remedies.
14. Website and Account Security. Your use of EQ Telecom’s website, portals, self-care tools, checkout flows, account-management tools, and communications tools is subject to any applicable Website Terms of Use and other posted policies. If you create an online account, you agree to provide accurate, complete, and current information and to keep your login credentials secure. You are responsible for all activity that occurs under your account, whether by you or by anyone using your credentials. Notify us immediately if you suspect unauthorized use, fraud, credential compromise, SIM swap attempts, account takeover, or other security issues.
EQ Telecom may impose security requirements, verification procedures, session limits, fraud checks, identity checks, or account holds at any time to protect you, our systems, and third parties.
15. Changes to Terms; Updates and Notification. We may update, revise, supplement, replace, or modify these Terms at any time, including to reflect changes in law, regulation, carrier requirements, platform requirements, taxes or fees, business practices, product offerings, or service functionality. When we do, we will post the revised Terms on our website, and the revised Terms will become effective upon posting or on any later effective date stated in the update.
We may, but are not obligated to, provide additional notice of material changes by email, account notification, website banner, or other communication method. It is your responsibility to review these Terms regularly. Your continued use of any service, continued maintenance of an active account, payment of charges, renewal of service, or purchase of products after updated Terms become effective constitutes your acceptance of the updated Terms.
16. Dispute Resolution. Any dispute, claim, or controversy related to these Terms, your account, your device, your service, any plan, any purchase, any billing matter, any advertisement, or any interaction with EQ Telecom will be resolved as follows: First, you must contact us and attempt in good faith to resolve the matter informally. If the dispute is not resolved within 60 days after notice, then any claim or dispute arising out of or relating to this Agreement, our services, or your devices will be resolved by binding arbitration on an individual basis.
Arbitration will be governed by the Federal Arbitration Act and any applicable arbitration rules, except to the extent such rules are inconsistent with these Terms. The hearing location will be in a mutually agreed location in Utah, unless otherwise required by applicable law or agreed by the parties. The arbitrator’s decision shall be final and binding, subject only to very limited rights of appeal under applicable law.
To the fullest extent permitted by law, you and EQ Telecom each waive any right to a jury trial and any right to participate in a class action, collective action, representative action, private attorney general action, or consolidated proceeding regarding claims subject to arbitration. The arbitrator may award relief only on an individual basis.
Notwithstanding the foregoing, either party may seek judicial relief for disputes involving intellectual property infringement, unauthorized use of a name, trademark, logo, portal, or account, or requests for injunctive or equitable relief where such relief is legally available. As an alternative to arbitration, either party may bring qualifying claims in small claims court in the relevant Utah county, subject to jurisdictional limits and applicable law.
17. No Warranty; Limitation of Liability. THE SERVICE IS PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. EQ TELECOM AND ITS SUPPLIERS, LICENSORS, VENDORS, PARTNERS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR SYSTEM INTEGRATION.
WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, SECURE, TIMELY, OR FULLY COMPATIBLE SERVICE. WE DO NOT GUARANTEE COVERAGE, NETWORK AVAILABILITY, DATA SPEEDS, SPECIFIC FEATURES, MESSAGE DELIVERY, CALL COMPLETION, DEVICE COMPATIBILITY, PORTING SUCCESS, ACCOUNT ACCESS, OR THE PERFORMANCE OF THIRD-PARTY SYSTEMS.
Equipment you purchase may come with a manufacturer’s warranty or third-party warranty. Except as expressly required by law, EQ Telecom disclaims all warranties for device hardware, accessories, SIMs, and related products.
EQ Telecom’s services depend on third-party providers, including wireless network operators, MVNA/MVNE or OSS/BSS providers, provisioning vendors, billing systems, payment processors, tax engines, logistics providers, customer-support platforms, software vendors, cloud providers, device manufacturers, and other infrastructure partners. EQ Telecom is not responsible for failures, interruptions, delays, incompatibilities, outages, errors, losses, or degraded service caused by these third-party systems or providers.
Network performance may be affected by network management practices, including prioritization, deprioritization, throttling, congestion management, maintenance, carrier-side controls, fair-use limitations, fraud-prevention measures, capacity limits, system upgrades, outages, and changes to third-party networks or platforms.
TO THE FULLEST EXTENT ALLOWED BY LAW, EQ TELECOM, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, CONTENT PROVIDERS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF USE, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF COMMUNICATIONS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THESE TERMS, THE SERVICE, ANY DEVICE, ANY ACCOUNT ISSUE, ANY PORTING ISSUE, ANY SUSPENSION, ANY TERMINATION, OR ANY THIRD-PARTY FAILURE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT ALLOWED BY LAW, EQ TELECOM’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE, ANY DEVICE, OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO EQ TELECOM FOR THE SERVICE OR DEVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR, IF LESS, THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC SERVICE OR DEVICE GIVING RISE TO THE CLAIM.
IN NO EVENT WILL EQ TELECOM BE LIABLE FOR FAILURE TO PROVIDE SERVICE OR FOR DELAYS, INTERRUPTIONS, OR ERRORS RESULTING FROM EVENTS BEYOND OUR REASONABLE CONTROL, INCLUDING NETWORK OUTAGES, WEATHER, FORCE MAJEURE, GOVERNMENT ACTIONS, FRAUD REVIEWS, LEGAL COMPLIANCE HOLDS, VENDOR FAILURES, CARRIER ACTIONS, OR THIRD-PARTY PLATFORM FAILURES.
SOME STATES MAY NOT ALLOW CERTAIN WARRANTY EXCLUSIONS OR LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
18. Governing Law. These Terms and your use of EQ Telecom’s services are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Subject to the arbitration provisions above and any rights to proceed in small claims court, any legal action or proceeding arising under these Terms or related to your use of EQ Telecom’s services shall be brought exclusively in the federal or state courts located in Utah, and you and EQ Telecom consent to the personal jurisdiction and venue of those courts.
19. Miscellaneous. These Terms apply to all services, products, devices, SIMs, eSIMs, websites, portals, features, and offerings provided by EQ Telecom. If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. No failure or delay by EQ Telecom in exercising any right, power, or remedy will constitute a waiver of that right, power, or remedy. Any waiver must be in writing to be effective.
EQ Telecom may assign, transfer, delegate, or subcontract its rights or obligations under this Agreement to an affiliate, successor, acquirer, assignee, or service provider without notice to you to the extent permitted by law. You may not assign or transfer your rights or obligations without our prior written consent.
This Agreement, together with any other policies or disclosures referenced in it, including the Privacy Policy, Acceptable Use Policy, Return Policy, and Website Terms of Use, constitutes the entire agreement between you and EQ Telecom regarding the services and supersedes all prior or contemporaneous understandings, statements, communications, or agreements relating to the same subject matter, whether oral or written.
Nothing in these Terms creates any partnership, agency, employment, joint venture, fiduciary, or franchise relationship between you and EQ Telecom.
